According to international and EU law, EU Member States have committed to offering protection to those who have to leave their home country to seek safety from persecution or serious harm.<\/p>\n
The reality in Europe shows: We face a normalisation legalisation of pushbacks and related human rights violations at land and sea borders across Europe. We also observe more and more a practie of hindering of access through different legal ways.<\/b><\/p>\n
We observe the goal to establish a widespread and prolonged detention-system at Europes external borders as well as derogations from existing safeguards and fundamental rights guarantees.<\/p>\n
Giota Massouridou is Lawyer in Greece and defended serveral asyllum-cases at the ECHR. She was a leading part of a Lawyers Group to oppose and challenge the EU-Turkey-Argreement. She is challenging pushbacks in concrete cases at national courts as well as on a European Level. She is an Expert in Asylum Law and follows as such conferences and seminairs on an international Level.\u00a0<\/span><\/p>\n Wiebke Judith works as a policy and advocacy officer for PRO ASYL, a German NGO working for the human rights of asylum-seekers and refugees in Germany and Europa. She follows closely he reform of the Common European Asylum System and is part of an NGO-Network trying to defend human and refugee rights in Europe in order to oppose border-procedures and detention at Europes external borders.\u00a0<\/span><\/p>\n The workshop wants to give in its first part an overview concerning the recent factual and legal developments concerning the situation at European Borders and the new \u201emanagement\u201c of asylum and migration in Europe.\u00a0<\/span><\/p>\n In the second part of the workshop we want to discuss, the legal condition, framing and shift from protection to fighting against refugees. Our aim is together with all participants of the workshop to discuss, how to oppose legally and politically.\u00a0<\/span><\/p>\n The workshop will be in English. Wir wollen uns diesem Thema aus zwei Richtungen n\u00e4hern. Einmal auf der praktischen rechtlichen Ebene aus Sicht der Anw\u00e4ltin vor Ort und andererseits von der politischen Metaebene, die letztlich den universellen rechtlichen, materiellen Gehalt der Menschenrechte immer weiter relativiert.\u00a0<\/span><\/p>\n Der Umgang Griechenlands mit Gefl\u00fcchteten ist, wie Giota Massouridou darstellen wird, Ausdruck europ\u00e4ischer Politik und steht daf\u00fcr, welche Relativierung Menschenrechte in Europa erfahren. Das griechische Hotspot<\/em>-System dient als Laboratorium der Weiterentwicklung des europ\u00e4ischen Asylsystems. Verk\u00fcrzt gesagt geht es darum, dass rechtswidrig staatliches Handeln etwa im Bereich Pushbacks<\/em> nicht nur nicht sanktioniert wird, sondern im Gegenteil zu einer Anpassung des Rechtsrahmens f\u00fchrt. Giota Massouridou arbeitet als Anw\u00e4ltin konkret in Pushback<\/em>-Verfahren oder in Verfahren vor griechischen Gerichten sowie dem EGMR zur Frage der sicheren Drittstaaten. Giota Massouridou ist ELENA- Koordinatorin (European Legal Network on Asylum<\/em>) f\u00fcr Griechenland und Generalsekret\u00e4rin der Europ\u00e4ischen Demokratischen Anw\u00e4ltinnen<\/em> (EDA).\u00a0<\/span><\/p>\n Wiebke Judith besch\u00e4ftigt sich als rechtspolitische Sprecherin von Pro Asyl<\/em>\u00a0 intentsiv mit dem europ\u00e4ischen Reformprozess im Bereich Asyl und Migration und analysiert diesen sowohl in rechtlicher wie auch in politischer Hinsicht. Zuletzt ist\u00a0 Pro Asyl<\/em> zusammen mit anderen effektiv gegen die von der Kommission vorgeschlagene InstrumentalisierungsVO, die den EU-Mitgliedstaaten in Situationen der \u201eInstrumentalisierung\u201c von Migration und Asyl erm\u00f6glicht h\u00e4tte, von ihren Verpflichtungen nach dem EU-Asylrecht abzuweichen, vorgegangen.\u00a0<\/span><\/p>\n In unserem Workshop wollen wir die rechtliche und die politische, die konkrete und die abstraktere Perspektive zusammenbringen.
